Depends.

The "dark web" simply refers to websites that are not indexed by regular search engines, like intranet servers with websites only accessible within a specific business or company.

Most "dark web" sites that are actually illegal tend to run through multiple proxies and cloak their true location via other means, meaning the police must determine who owns it IRL via other information (they shut down the Silk Road drug selling darknet site by tracking data used on the regular internet they knew matched up with darknet activity by the guy who ran Silk Road).
